Nowadays Chinese herbal medicines have gained popularity in the world. Unlike western medicines which are chemical synthesis products, Chinese herbal medicines are herbs of natural substances containing complex ingredients.
Given that it is not appropriate to apply the current pharmaceutical examination criteria on Chinese herb-related inventions, the Taiwan Intellectual Property Office (TIPO) thus “ custom-designed” the world first examination guidelines specifically for Chinese herb-related inventions in early 2008.
Said examination guidelines provide information on patentable subject matter and addressed how their characteristics and mode of preparation, etc. could meet the requirements of patentability on the basis of product claims, process claims and use claims under the current patent system.
