【Duration】

The trade mark registration is valid for initial term of 10 years from the registration date. Each renewal application for further terms of 10 years can be made successively within 6 months from the date of expiry

Non-Traditional Marks – 3 Dimensional, Hologram, Color, Sound, Smell, etc.,

【Filing Requirements】

Multi-Class Application – One trade mark application may cover more than one class of goods and/or services (12th Edition of Nice Classification of Goods/Services). There are reductions on service/official fees for each additional class
A statement of claim of a 3-dimensional shape as a trade mark or as an element of trade mark shall be stated in the application form with a faceted view specimen
A trade mark consists solely or in part of a colour/colours, sound, smell or other unconventional mark, a description of the mark or a statement of fact should be stated in the application form
Series of trade mark is applicable in Hong Kong. Series of Trade Mark application contains two or more marks (maximum of 4) having the same or similar design and of the same general character, which resemble each other as to their material particulars and differ only as to matters of a non-distinctive character not substantially affecting the identity of the trade mark

Applicant’s name and address
The type of applicant (individual, incorporated entity or unincorporated entity); if the applicant is a corporation, the country/region of incorporation must be indicated; if the corporation is incorporated in the United States, please provide the state of incorporation
Specification of goods and/or services to be claimed
A print of the mark
If convention priority is claimed, the name of the country or territory where the priority application was filed, the priority application number and the priority filing date are required

【Renewal】

Renewal fee is payable by the end of each 10 years protection period
