The Taiwan Intellectual Property Office (TIPO) announced on November 22, 2011 that an applicant of patent and/or trademark application can file a request for reinstatement if the delay of statutory deadline was caused by the recent floods in Thailand and/or earthquakes in Turkey.
The above remedial measure is based on the Article 17 -1 of the Patent Act, and Article 9 of the Trademark Law in Taiwan. Specifically, if the delay of statutory deadline is caused by natural calamities or others not attributable to the applicant, then the applicant may file for a request of reinstatement within 30 days after the termination of such cause, and not beyond one year of the statutory time limit.
