The protection term of a registered trademark in Taiwan is ten years from the publication date of registration, and can be renewed every ten years. The trademark right owner(or an interested party such as the assignee, pledgee)can file a request for renewal of trademark right with Taiwan Intellectual Property Office(TIPO), within six months prior to the expiration of 10-year term, and pay renewal fees at NT$4000 for each class of goods / services. If the renewal request is filed within the six-month grace period from the expiry date, the trademark right owner is required to pay twice the amount of original renewal fees.
The applicant can file a renewal request to cover all or part of the trademark right. It is not allowed to amend the registered trademark or increase the items and classes of goods / services. However, the number of designated goods or services can be reduced when filing a renewal request. The renewal fees should be paid according to the number of classification of goods / services if any reductions are made. If the applicant has filed a renewal request but decides to abandon the registered trademark, an application to withdraw the renewal request and apply for a refund of renewal fees could be made before TIPO approves the renewal request.
A foreign applicant can appoint the originally recorded agent or another agent with special appointment to file a request of trademark renewal with TIPO. If the applicant has appointed another agent to file trademark renewal, a power of attorney should be submitted when filing the renewal request, or within 2 months as requested by TIPO. Also, per Rule 6 of Enforcement Rules of Trademark Act, an agent may carry out all acts on behalf of the trademark applicant, but the right to withdraw an application or abandon a trademark right may only be carried out by specifying such powers delegated to the agent. If an agent is instructed to withdraw the request of trademark renewal, it should be stated clearly in the power of attorney that the agent is specially empowered to file the withdrawal application. The failure to submit the required power of attorney may cause the dismissal of the withdrawal application, and the renewal fees will not be refunded(unless the renewal request was incorrectly filed by the applicant).
