In the past years, it is required to submit a separate application for each patent case when recording the change of particulars for more than one patent case. In order to simplify the recordation process, Taiwan Intellectual Property Office (TIPO) announced the recordation of change on multiple patent cases could be filed by a single application form starting from November 2014. Namely, the applicant can combine the recordation of change for multiple patent cases into one application form. Said recordation of change may include not only the name and address of applicant, but also the name change of inventor, patent agent, etc.
Required documents
- One written application
The applicant can state the application numbers or patent numbers in a single application form, or attach a list of patent cases; yet a separate application must be filed for pending applications and granted patents, respectively. . - Official fee
Basically, it is required to pay an official fee of NT$300 for each patent case when recording the name change (or several name changes such as the name change of applicant, inventor and patent agent, or a serial of name changes of applicant, which are to be filed at the same time). Thus a total fee depending on the number of patent cases to be recorded should be payable for filing the single application. For example, if a single application for name change is to be filed for 10 patent cases, then a total official fee of NT$300 X 10 = NT$3000 must be paid when filing the single application. - Power of Attorney
The applicant can appoint the original recorded patent agent to file the recordation or specially appoint another patent agent without taking over the representation to file the recordation; yet each application must be accompanied by a power of attorney on file or a newly produced power of attorney. - Other documents
Normally, an evidencing document is required only when recording the name change of foreign applicant. This should be a government-issued document showing the name change, and its notarized document is acceptable. For recording other changes, it is generally not required to submit evidencing documents unless otherwise requested by TIPO.
In addition, it is not necessary to submit the original patent certificate when the applicant files the recordation of name change. Even though the applicant may return the original patent certificate for the annotation of his name change, yet said annotation cannot be made if the applicant has adopted this single-application process to file his recordation of name change for multiple patent cases.
