The Taiwan Intellectual Property Office (TIPO) has set a time schedule for processing various trademark matters. The standard processing time for major filing matters are listed as follows.
| Trademark Matter | Processing Time |
|---|---|
| Application for Registration | 8 months |
| Application for Renewal | 2 months |
| Application for Division | 2 months |
| Revocation Trial | 6 months |
| Opposition | 5 months |
| Invalidation Trial | 6 months |
Remark:
The above processing time does not include the time period for notification of outstanding documents or filing their responses.
Per TIPO’s practice, the examination of a trademark application generally takes a shorter period of time than the standard time schedule. For trademark applications filed in 2019, the average time for first office action pendency and disposal were 5.2 months and 6.7 months, respectively. On the other hand, TIPO began a “fast-track” trial examination for trademark applications filed on/after May 1, 2020. If a new trademark application has met the “fast-track” requirements, its processing time may be about two months faster than that of a normal trademark application. Therefore, the applicant can utilize this “fast-track” examination system for obtaining early trademark protection.
